1. Scope & Contracting Party
These General Terms and Conditions (GTC) apply to all contracts, deliveries and other services concluded via the websites quoala.ch and quoala.de. Differing terms of the customer are not recognised.

2. Exclusion of Commercial Resale
Our products are sold exclusively for private use (as an end consumer). The commercial resale of QUOALA products is strictly prohibited.
All QUOALA items are trademark-protected. In the event of any infringement, unauthorised resale on third-party platforms (e.g. Amazon, eBay) or in brick-and-mortar retail, we reserve the right to take legal action, claim damages and permanently exclude the customer from the shop.
3. Conclusion of Contract & Prices
3.1 Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By clicking the "Buy" / "Order with obligation to pay" button, you place a binding order. The contract is concluded when we accept your order by an order confirmation via email or ship the goods.
3.2 Prices
Price changes are reserved at any time. The prices displayed in the shop at the time of ordering, in Swiss francs (CHF) or euros (EUR), apply.
4. Payment & Retention of Title
4.1 Payment: We offer various payment methods (e.g. credit card, TWINT, PayPal). Your account is usually charged immediately after placing the order.
4.2 Retention of Title: Until full payment has been made, the delivered goods remain the unrestricted property of GGA Basmadjian Trading.
5. Vouchers & Discounts
Promotional vouchers and discount codes are valid only within the stated period and can be redeemed only once per order. Individual products may be excluded from promotions. Cash payout or subsequent crediting is excluded. Multiple discount codes cannot be combined with each other.
6. Shipping, Withdrawal & Warranty
6.1 Shipping & Delivery: Delivery conditions and shipping costs are governed by our separate

6.2 Right of Return / Withdrawal: Information on returning goods can be found in our
Refund Policy.
6.3 Warranty (Liability for Defects): The statutory warranty provisions apply. We provide a guarantee for the freedom from defects and functionality of our products under proper use. Normal wear and tear or damage caused by improper handling are excluded.
7. Intellectual Property & Image Use
All content on quoala.ch and quoala.de (in particular photographs, product images, texts, blog posts, graphics, logos and product designs) is protected by copyright and the sole property of GGA Basmadjian Trading.
Prohibition of Unauthorised Use (Content Theft):
Copying, downloading, reproducing or otherwise using our images, listings and editorial texts for your own commercial purposes (e.g. for other online shops, marketplaces or social media marketing) is strictly prohibited. In the event of any infringement, we reserve the right to take legal action without prior contact. This includes claims for injunctive relief, the demand for damages and the passing on of all legal costs.
8. Platform Use & Disclaimer
8.1 Accuracy of Information: We accept no responsibility for inaccurate or outdated information. Errors regarding product descriptions or availability may occur and can be corrected at any time.
8.2 Limitation of Liability: We do not guarantee that the use of our service will be uninterrupted or error-free. To the extent permitted by law, we exclude any liability for indirect or incidental damages arising from the use of our products.

9.2 Severability Clause: Should any provision of these GTC be wholly or partially invalid, the validity of the remaining provisions remains unaffected.
9.3 Changes to the GTC: We reserve the right to update these GTC at any time. The version current at the time of ordering applies.
9.4 Applicable Law & Jurisdiction: These GTC are governed entirely by Swiss law. The exclusive place of jurisdiction for all disputes is Zürich, Switzerland. Mandatory consumer protection provisions of the customer's country of residence are reserved.
